Brain injuries in athletics can be caused by many different things such as:

  • Defective sports equipment, such as helmets
  • Over-aggressive players in sports
  • Improper coaching
  • Failure to properly referee

As a result of the increase in sports injuries, Colorado recently passed the Jake Snakenburg Youth Concussion Act, which was codified by the legislature as C.R.S. ยง25-43-101 et. seq., and went into effect on January 1, 2012. This Act lays out the responsibilities of coaches when a player has suffered a concussion as a result of participating in youth athletics. This includes mandatory completion of an annual concussion recognition education course. If a coach observes a player incur a blow to the head that he or she believes may have resulted in a concussion he or she must remove the player for the rest of the game.

This new Act also provides that coaches must inform parents of the injury, and a player cannot return to organized sports without proper clearance by a health care professional. As a result of this Act, if a coach does not comply with its provisions he or she can be held liable if he or she does not act appropriately after a player suffers a blow to the head, especially if they lose consciousness.

Additionally, the Colorado High School Activities Association (“CHSAA”) has its own rules and regulations that mirror what the act provides, but are even stricter.

Often, people involved in sports who sustain a concussion and do not feel right do not want to admit something is wrong because they want to keep playing and do not want to risk letting down their teammates or coach. Parents, as well as coaches and fellow players, need to be aware and diligent if they notice something is not right.
